Terms of Service

1. The agreement

These Terms govern your access to and use of the Daily+ application, the Daily+ API and this website (together, "Daily+"), provided by Daily+ (sole trader — registered entity TBC before launch), Registered address TBC before launch, Romania.

By installing the app, creating an account, or continuing to use Daily+, you accept these Terms. If you do not accept them, do not use Daily+.

The Subscription Terms, the Acceptable Use Policy, the Medical Disclaimer and the AI Transparency notice form part of this agreement. The Privacy Policy is not part of the contract but describes how we handle your data.

2. Who may use Daily+

You must be at least 16 years old and able to enter into a binding contract. If you are using Daily+ on behalf of an organisation, you confirm you are authorised to bind it.

Daily+ is not intended for anyone under 16. If we learn that an account belongs to someone under 16 we will close it and delete its data.

3. Your account

Core features of Daily+ work locally without an account. An account is optional and adds synchronisation across your devices, household sharing, and access to server-side features such as AI.

You are responsible for keeping your credentials confidential and for activity under your account. Tell us promptly at support@dailyplus.app if you believe your account has been used without your authorisation. We are not liable for losses arising from your failure to safeguard your credentials.

You may sign out of individual sessions in the app, and you may delete your account at any time — see the account deletion page.

4. Your content

Everything you log, write, photograph or upload is yours. You keep ownership of it.

You grant us only the licence we need to operate the service for you: to store your content, to transmit it to devices and household members you have chosen, and to process it to produce the features you asked for. That licence ends when the content is deleted. We do not use your content to train AI models and we do not license it to anyone else.

You are responsible for having the right to upload what you upload, and for anything you publish to a household or a public audience within the app.

5. Acceptable use

The Acceptable Use Policy sets out what is not allowed — in summary: no unlawful use, no interference with the service or other users, no attempts to circumvent security or entitlement checks, no scraping or automated bulk access, and no abusive or harmful content in shared spaces.

We may suspend or terminate access for a material or repeated breach. Where it is reasonable to do so we will warn you first and give you a chance to put it right.

6. Subscriptions

Some features require a paid subscription, purchased through the App Store or Google Play. The Subscription Terms describe pricing, renewal, cancellation, refunds and the EU right of withdrawal in full, and are part of this agreement.

In short: subscriptions renew automatically at the price shown at purchase unless you cancel at least 24 hours before the end of the current period; you manage and cancel them in your Apple ID or Google Play settings, not in Daily+; and deleting the app does not cancel a subscription.

7. Daily+ is not a medical device

Daily+ provides general wellness, fitness and nutrition information. It is not a medical device, it does not diagnose, treat, cure or prevent any condition, and it is not a substitute for professional advice. Recommendations it computes — energy targets, training progression, correlations, reminders — are informational.

Always consult a qualified professional before changing your diet, exercise or health routine, and never disregard professional advice because of something Daily+ showed you. The Medical Disclaimer has the full statement.

8. Availability and changes to the service

We aim to keep Daily+ available but we do not guarantee uninterrupted service. We may carry out maintenance, and we may change, add or remove features.

If we discontinue a feature you are paying for, or make a change that materially reduces what a paid subscription provides, we will tell you in advance and you may cancel and request a pro-rata refund of the unused paid period through the store you purchased from.

Because Daily+ is local-first, your own data remains on your device and exportable even if the service is unavailable.

9. Our intellectual property

Daily+, its software, design, trademarks and bundled content (exercise, ingredient and care datasets) are owned by us or our licensors. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use Daily+ for your own non-commercial purposes.

You may not copy, modify, reverse-engineer, resell or create derivative works from Daily+ except to the extent that mandatory law permits it. Third-party components are used under their own licences, which are listed in the app.

10. Warranties and liability

Daily+ is provided "as is" and "as available". To the fullest extent permitted by law we exclude implied warranties of merchantability, fitness for a particular purpose and non-infringement.

Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law. If you are a consumer in the EU or UK, your statutory rights are unaffected and this section applies only so far as the law allows.

Subject to the above, we are not liable for indirect, incidental, special or consequential loss, for lost profits, or for loss of data that you could have avoided by using the export feature. Our total aggregate liability arising from Daily+ in any 12-month period is limited to the greater of the amount you paid us in that period and EUR 50.

11. Termination

You may stop using Daily+ at any time and delete your account from within the app or via the account deletion page.

We may suspend or terminate your access if you materially breach these Terms, if we are required to by law, or if continuing would create a security or legal risk. Where we terminate without cause we will give reasonable notice and refund the unused portion of any paid period.

Sections that by their nature should survive — your content licence wind-down, intellectual property, warranties and liability, and governing law — survive termination.

12. Changes to these Terms

Each version carries a version identifier and an effective date, shown at the top of the page, and the app records which version you accepted.

For material changes we will notify you in the app at least 30 days before they take effect and ask you to accept the new version. If you do not accept, you may stop using Daily+ and, if you have a paid subscription, cancel it and request a pro-rata refund for the unused period.

13. Governing law and disputes

These Terms are governed by the laws of Romania (EU), without regard to conflict-of-law rules. If you are a consumer, you also keep the protection of the mandatory law of the country you live in, and you may bring proceedings in the courts of that country.

Before going to court, please contact us — most disputes are resolved by email. EU consumers may also use the European Commission’s online dispute resolution platform.

14. General

These Terms, together with the documents named in §1, are the entire agreement between us about Daily+. If a provision is found unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it. You may not assign this agreement; we may assign it as part of a merger or sale of the business, on notice to you.
